Grafiora

These terms are the agreement between you and the Grafiora team (“we”, “us”) for your use of the Grafiora app and this website (together, “the service”). By creating an account or using the service you agree to them. If you do not agree, please do not use Grafiora.

The privacy policy explains what we collect and why; it is part of this agreement.

1. What Grafiora is

Grafiora is a private app in which a family keeps memories of a child and of each other: photos, videos, written stories, milestones and the people in them, arranged on a timeline, and books made from them. A family is created by one person, who invites the others. There is no public part of the service: nothing a family adds can be seen by anyone the family has not invited.

Grafiora is in its first release. We will add to it, change it and fix it over time, and we will tell you about changes that matter to how you use it.

2. Your account

You must be at least 18 years old to create an account. You sign in with a phone number that is yours; you agree to keep the codes Grafiora sends you to yourself, to keep any email address you add up to date, and to tell us promptly if you believe someone else has used your account. An account is for one person and may not be shared. You are responsible for what is done with your account.

3. Families, owners and members

The person who creates a family is its first owner, and an owner can make any member an owner too. Owners invite people, revoke invitations, remove members and rename the family; an owner can leave, or be removed by another owner, as long as the family keeps at least one owner. If the last owner deletes their account, the member who has been in the family longest becomes its owner. Every member can add memories and see everything the family holds. When you invite someone you are choosing to show them the whole family, and you are responsible for that choice. An invitation is a link that only the person who signs in with the invited phone number can accept; do not send it to anyone else.

Accepting an invitation to a family means agreeing to these terms for your use of that family too.

4. Your content

Everything you add to Grafiora, in words, photos and videos, remains yours. You give us only the permission we need to run the service: to store your content, to show it to your family’s members, to make the display copies and memory books the app produces from it, and to keep it safe. We claim no other right in it, and we do not use it for advertising or to train models.

You are responsible for your content. By adding it you confirm that you have the right to share it with the members of your family, including where it shows other people, and that it breaks no law and no one’s rights. Content about children is added by their parents and guardians, who are responsible for it as they would be for a family album.

Photo details such as the time and place a photo was taken come from what the photo file recorded and are shown as they were recorded; they may be missing or wrong, and you can correct the memory’s date yourself.

Grafiora is a home for memories, not a backup service. Keep your own copies of anything you could not bear to lose. We work hard to keep your content safe, but we do not promise that it can never be lost.

5. What you may not do

You agree not to use the service:

  • to store or share anything unlawful, or anything that sexualises, exploits or endangers a child;
  • to harass, threaten or deceive anyone, or to add content about people who have asked you not to;
  • to reach a family you are not a member of, or to try;
  • to probe, overload, scan or interfere with the service, or to get around its access controls;
  • to copy, modify, reverse engineer or resell the service, except where the law allows it regardless of these terms;
  • to use automated means to extract data from the service.

We may remove content and suspend or close accounts that break these rules, and will tell you when we do unless the law prevents it. Content that endangers a child will be reported to the authorities.

6. Deleting things

A memory you delete is kept for thirty days in “Recently deleted”, where you or a family owner can restore it; after that it is permanently erased with its files. A photo or video removed from a memory follows the same thirty days.

You can delete your account at any time, in the app under Settings, Account; Delete your account explains how, what is erased and what a family you shared with others keeps.

7. Price

Grafiora is free to use in this release. If we ever charge for any part of it we will tell you clearly beforehand, and nothing you have already added will be held back from you for payment.

8. Our property

The Grafiora app, this website, their design, software, name and artwork belong to us and our licensors. These terms give you a personal, non-transferable right to use the app to keep your family’s memories, and nothing more. Suggestions you send us may be used without obligation to you.

9. Availability and disclaimers

We aim to keep Grafiora available and working, but it is provided “as is” and “as available”, without warranties of any kind, express or implied, to the extent the law allows. We do not promise that it will be uninterrupted or free of errors, and it may be unavailable during maintenance or for reasons outside our control.

10. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential loss, or for loss of data, profits or goodwill, arising from your use of the service. Where liability cannot be excluded, our total liability to you for all claims together is limited to the greater of the amount you paid us for the service in the twelve months before the claim and fifty euros. Nothing in these terms limits liability that cannot be limited by law.

11. Ending the agreement

You can stop using Grafiora at any time and delete your account. We may suspend or close an account that breaks these terms or threatens the service or other users, with notice where the law allows it. Sections that by their nature outlast the agreement, including those on your content, our property, disclaimers and liability, do so.

12. Changes to these terms

We may change these terms, for example when the service gains a feature or the law changes. For a material change we will tell you in the app, or by email if you have given us a verified address, before it takes effect, and the effective date at the top will show the current version. Using Grafiora after that date means the new terms apply.

13. Governing law

These terms are governed by the laws of the Federal Democratic Republic of Ethiopia. We will first try to settle any disagreement with you in good faith; failing that, the competent courts of Ethiopia have jurisdiction, without prejudice to any protection the law of your own country gives you as a consumer.
